Terms & Conditions

1. The Promoter

These prize draws and prize competitions ("Promotions") are operated by Cloud 9 ("Cloud 9", "we", "us"), a company registered in England and Wales, company number to be confirmed before entries open, registered office to be published before entries open. Contact: support@cloud9draws.co.uk.

Cloud 9 operates its Promotions as (a) free prize draws (with a genuine free entry route) and/or (b) prize competitions (with a genuine element of skill). They are not licensed gambling and do not require a Gambling Commission licence, provided the conditions in clause 4 are met.

2. Acceptance

By entering, you accept these Terms and our Privacy Policy. If you do not agree, do not enter.

3. Eligibility

• Open to residents of England, Scotland and Wales aged 18 or over at the time of entry.
• Excluded: employees, officers and agents of Cloud 9, their immediate families and households, and anyone professionally connected with the Promotion.
• One verified identity per person. We may request proof of age, identity and address before awarding any prize.

4. How to enter (paid route, free route & skill)

Each Promotion is run so that it qualifies as a free prize draw and/or prize competition:

• Paid entry: purchase one or more entries at the price shown (as published on the relevant competition page).
• Free entry route (no purchase necessary): you may enter free of charge by post — send your full name, address, email, date of birth and the Promotion name to the postal address shown on the relevant free-entry page. Each valid postal entry receives the same number of entries and the same chance of winning as one paid entry. The per-person free-entry limit is published on the relevant free-entry page. The free route is offered with equal prominence to the paid route.
• Skill element: all entrants (paid and free) must correctly answer the published skill question to be entered. Incorrect answers are not entered and (for paid entries) are not refunded except as required by law.

Entries open and close on the dates shown for each Promotion (as published on the relevant competition page). Entries received after the closing time are void. The maximum number of entries per person is published on the relevant competition page.

5. Prize structure — cumulative ladder

Each Promotion has a prize ladder tied to the total entry pot reached by the closing date. The ladder is cumulative: the winner receives every prize tier unlocked up to the highest threshold reached. Default ladder (exact figures shown on each Promotion page):

If a threshold is not reached, the corresponding tier(s) are not awarded. Minimum guarantee: if the pot does not reach the lowest threshold (Tier 1, £50,000), the Promotion is cancelled and all paid entries are refunded in full.

6. Prizes are described by value, not brand

Specific makes, models, finishes and developments are illustrative. Cloud 9 may supply a prize of equivalent value and reasonably similar specification. Prize images are for illustration only.

7. Cash alternative (winner's choice)

For any prize tier, the winner may choose the stated cash alternative for that tier instead of a physical option. The cash alternative is a guaranteed option, paid by bank transfer within 14 days of identity verification.

8. Approval-dependent prizes & fallback waterfall (property & similar)

Some prizes — in particular overseas real estate — can only be transferred subject to government, regulatory or scheme approvals (for example, non-citizens may only acquire property in Mauritius under approved schemes and with the relevant authority's consent). Where a physical prize cannot lawfully be transferred to a particular winner, the following fallback waterfall applies, in order:

1. The stated prize (e.g. the Mauritius property), where the winner is eligible and all approvals are obtained. Cloud 9 will bear the associated transfer taxes, duties and registration costs up to the stated prize value.
2. If (1) is not possible, the equivalent UK alternative prize for that tier (e.g. a UK property of equivalent value), where deliverable.
3. If neither (1) nor (2) is possible, an enhanced cash prize equal to 70% of the stated tier value — higher than the standard 50% voluntary cash alternative, in recognition that the choice was not the winner's.

All approval-dependent prizes are expressly awarded "subject to applicable approvals and the winner's legal eligibility to receive them". The winner agrees to cooperate reasonably with eligibility and anti-money-laundering checks required to effect any transfer.

9. Winner selection & notification

Winners are drawn at random from all valid entries with a correct skill answer, using an auditable random selection process with draw records kept for review on the published draw date. Winners are notified by email/phone within 7 days. If a winner cannot be contacted or fails to respond/verify within 14 days, or is ineligible, Cloud 9 may redraw.

10. Claiming & verification

Prizes are awarded only after successful identity, age and eligibility verification. Cloud 9 may withhold or reclaim a prize awarded on the basis of false or incomplete information.

11. Taxes & costs

UK prize winnings are not normally subject to UK income tax. Cloud 9 bears the transfer taxes/duties/registration of a physical prize up to its stated value (clause 8.1). The winner is responsible for any ongoing costs of a physical asset (insurance, maintenance, service charges, future taxes) and for taking independent advice on their own tax position.

12. Publicity

Winners may be asked to take part in reasonable post-draw publicity and to allow use of their first name, county and image. A winner may request anonymity; Cloud 9 will still publish a surname initial and county to evidence a genuine winner.

13. Data protection

Cloud 9 is the data controller. We process entrants' personal data to administer the Promotion, verify eligibility, award prizes and (with consent) for marketing, in accordance with our Privacy Policy and UK GDPR. See Privacy Policy.

14. Responsible play

Entries should be affordable and for entertainment. We enforce an 18+ minimum, offer self-exclusion on request, and support a per-person spend limit of the active limit configured for the account or promotion.

15. Liability

Nothing limits liability for death/personal injury caused by negligence, fraud, or anything that cannot be excluded by law. Otherwise Cloud 9 is not liable for indirect or consequential loss, or for matters outside its reasonable control. Entrants' statutory rights are unaffected.

16. Cancellation, amendment & force majeure

Cloud 9 may amend these Terms, or suspend, cancel or modify a Promotion, where reasonably necessary (including events beyond its control), and will act fairly toward entrants if it does. Where a Promotion is cancelled before the draw, all paid entries are refunded in full.

17. Governing law

These Terms are governed by the laws of England & Wales and subject to the exclusive jurisdiction of its courts.
